Are Your Emails Being Archived Correctly?

Here’s a question most attorneys can’t answer confidently: if a client dispute from five years ago went to a bar complaint tomorrow, could you pull every relevant email from that period in 30 minutes?

If the answer is “I think so” or “probably,” you may not have compliant email archiving. This is a big problem for law firms.

Why Email Retention Matters for Law Firms

Legal professionals have strict obligations around document and communication retention. Most state bars require attorneys to retain client files, including correspondence, for a minimum of five to seven years after the matter closes. The stakes are even higher in litigation-heavy practices. Your emails can be subpoenaed, and failing to produce them has consequences.

But here’s the thing most people don’t realize: having email is not the same as having compliant, searchable, tamper-proof email archiving.

What “Compliant” Email Archiving Actually Means

True email archiving means:

  • Automatic capture of every inbound and outbound email, not just what’s in someone’s inbox
  • Immutable storage — End users cannot alter or delete archived emails.
  • Full-text search across years of correspondence in seconds
  • Chain of custody documentation — An email has to be proved it was unmodified
  • Retention policies that match your specific legal obligations (typically 7 years for law firms)

Simply keeping emails in Outlook or Gmail does not meet this standard. Emails can be deleted, inboxes get corrupted, and accounts get deactivated when staff leave — taking years of communication with them.

Microsoft 365 and Archiving

If your firm uses Microsoft 365, you have access to built-in archiving tools — but they need to be properly configured. Many firms have Microsoft 365 but have never turned on In-Place Archive, set retention policies, or enabled litigation hold. That means you’re paying for the platform but not actually protected.

Proper setup takes a few hours. Not having it set up correctly takes about one subpoena to become a very expensive problem.

We configure Microsoft 365 archiving for every law firm we work with as part of our standard setup. We help configure this correctly. Get a free assessment today.
