IT Compliance, HIPAA, and CMMC

We throw the word compliance around a lot, in regards to managed IT support. And for most business owners and attorneys, it feels like something someone else is supposed to handle.

Let’s break “IT compliance” down in plain English.

What Is IT Compliance, Exactly?

IT compliance means your technology systems meet the specific legal and regulatory standards required for your industry. These standards exist to protect sensitive data (i.e. patient records, legal files, government contracts, financial information) and the people whose information you hold.

Not being compliant isn’t just a technicality. It can mean regulatory fines, losing the right to handle certain clients, and lawsuits. In some cases, personal liability for the people running the business.

The Frameworks That Matter Most

HIPAA applies to any business that handles protected health information. If you’re a healthcare provider, a law firm with healthcare clients, or a business associate of a covered entity, HIPAA applies to you. Key requirements include encrypted data storage, access controls, audit trails, and a written incident response plan.

CMMC (Cybersecurity Maturity Model Certification) applies to any company that works with the Department of Defense or handles Controlled Unclassified Information (CUI). If your firm does government contracting work, this is not optional and the requirements are extensive.

NIST 800-171 is a framework closely tied to CMMC that defines specific security controls for protecting CUI. Many businesses need to meet this standard to maintain federal contracts.

State Bar Rules for attorneys add another layer. Most state bars have ethics rules around client data security, and a breach that exposes client information can trigger disciplinary proceedings on top of any regulatory penalties.

What Non-Compliance Actually Costs

HIPAA fines range from $100 to $50,000 per violation, per day, with a maximum of $1.9 million per violation category per year. CMMC non-compliance can mean losing federal contracts entirely. State bar disciplinary action can mean suspension.
